In a significant verdict, a Division Bench of the Gauhati High Court, Principal Seat today directed the State respondents to admit one Sangeeta Ngangom to the State sponsored MBBS/BDS course against the lone seat reserved for meritorious sports person.
Justice D Biswas and A Hazarika passed the order following an appeal filed by Sangeeta, a National Judo Player from Malom Tulihal.
The Division Court made the verdict after setting aside an earlier Single Division ruling that rejected a petition filed by the same applicant.
Sangeeta and some candidates appeared in the State sponsored MBBS/BDS entrance examination, 2005-06 and the final list of candidates was published on June 6, 2005, said advocate N Surendra Singh, who appeared on behalf of Sangeeta.
One Rabishwaree Asem, who appeared under Meritorious sportspersons category scored higher marks and hence she occupied 22nd position in the merit list of general category candidates.
Her name also appeared in the select list of Meritorious Sports persons, the counsel added.
Sangeeta's name was also shown among the waiting list candidates of the Meritorious Sportspersons, he said, adding that Rabishwaree was admitted against the lone seats reserved for the Meritorious Sportspersons.
Sangeeta challenged her (Rabishwaree) admission against the lone reserved seat for meritorious Sportspersons on the ground that she secured 22nd position in the merit list of the general category, thus she ought to have been admitted/adjusted against the general category seat only.
Had it been so done, the seat reserved for the meritorious sportspersons would have remained vacant and as such Sangeeta would have been made eligible for admission in the reserved seat.
Her prayer is to get admitted on this point.
