In a minor blow to the MSCP in the case with the BJP over the office plot, the Civil Judge, Junior Division, Imphal has passed an injunction against the MSCP forbidding its members from entering the site of the disputed office until the main case is disposed off.
The SP of Imphal West has been instructed to take up the necessary steps to implement the ruling of the Court which was passed on September 26.After perusing through the presentations put up by the petitioner (BJP) the Court studied the case on three premises; Whether the petitioner has prima facie case?; Whether the balance of convenience is in favour of the petitioner?; and Whether the petitioner would suffer irreparable injury if the prayer for injunction is not granted? After minutely going through the petition filed by the BJP along these three premises, the Court ruled that there is probability that the petitioners are entitled to the relief, which in other words mean that they have good prima facie case.
On the second premise, the Court ruled that the balance of convenience is in favour of the petitioners while balancing the conveniences between the parties.
