The Gauhati High Court, Imphal Bench today served show cause notice to the Speaker of Manipur Legislative Assembly, S Budhichandra and former secretary of Manipur Legislative Assembly Secretariat (MLAS), Th Megharaj, returnable within four weeks time, in the dispute over the DPC proceeding for appointment of the post of under secretariat and committee officer of the secretariat.
The direction of the court related was related with the dispute arising out of appointment of Rohit Sapam son of Sapam Budhichandra of Lamphel Sanakeithel and Robert Laitonjam of Khagempali said to be son in-law of former secretary of the Manipur Assembly Secretariat recently retired from service on superannuation as under secretary and committee officer respectively in MLAS.
The court of Justice T NK Singh issued the show cause notice stating that the DPC proceedings for appointment to the post of under secretary and committee officer now under dispute requires to be perused by the court to the respondent no.1 represented by the secretary of MLAS and no.2 represented by Speaker of the Assembly.
The court after hearing the arguments from counsels of both sides of petitioners and respondents also directed to make the proceeding of the said DPC available before the court in the next date of hearing.
Advocate M Hemachandra is the counsel of the petitioners while advocate L Birendrakumar for former Assembly Secretary and Speaker.
The petitioners of the case were John Pulamte (38) son of Lalthlunglien of Rengkai village, Churachandpur district and Reena Laishom (33) daughter of L Ranamohan of Keishamthong Leishom Leirak, Imphal.
The two respondents who were among the four official respondent and two private respondents, Rohit Sapam who is working as under secretary of MLAS and Robert Laitonjam who is working as committee officer of MLAS.
The petitioners prayed the court for quashing and setting aside the entire Departmental Promotional Committee (DPC) meeting for the appointment of under secretary and committee officer held on July 4 and 5, 2009 appointing the two private respondents stating that their appointment is total violation of the existing recruitment rules for the said posts.
They also alleged that it also violated by holding improper, illegal, bias, nepotism and favouritism and name sake DPC for the said posts by the Assembly Secretary and Speaker.
