Chief Judicial Magistrate (Imphal) has passed a decree charging an Engineer of Power Grid Corporation of India of dwindling an amount of Rs 88,000 from the provident fund of an employee.
The Engineer concerned namely A Saratchandra Singh of Ninthoukhong in Bishnupur district and a Junior engineer in PGCI Imphal sub-station, Yurembam has been convicted under section 409 IPC (Criminal breach of trust by public servant, or by banker, merchant or agent) by the court of chief judicial magistrate (Imphal).
Special public prosecutor (CBI), H Chandrajit Sharma, who appeared on behalf of the independent probe agency, said a person convicted under this section is liable for 10 to 15 years imprisonment sentence or life term.
The same court will pronounce the sentence term against accused Saratchandra on December 21, he added.
Case dossiers said Saratchandra (52) received a demand draft for Rs 2,08,000 in favour of a senior attendant of PGCI, Loktak project, Md Islamuddin Barbhuiya .
Rather than hand over the draft, Saratchandra opened an account on October 18, 2001 in the name of Islamuddin at SBI, Secretariat branch Imphal and deposited the same in it, the dossiers mentioned.
The accused reportedly withdrew the amount on different dates - Rs 1, 70,000 on October 20, 2001, Rs 30,000 on October 27, Rs 7000 on November 2 and Rs 1000 on
November 28 .
The accused then visited Shillong and made three demand drafts of Rs 40,000 each in favour of Islamuddin from an SBI branch payable to SBI Loktak HEPA branch, Manipur.
On his return, Saratchandra delivered the drafts to Islamuddin by falsely stating that a sum of Rs 1,20,000 was sanctioned as his provident fund advance.
Noticing Saratchandra's fraudulent practice, Islamuddin submitted a representation on July 15,2002 to the secretary, PGCI, Shillong.
The dossiers further said the accused delivered a false and fictitious statement to Islamuddin showing that the competent authority had sanctioned Rs 1,20,000 (Rs 80,000 from the employee's contribution and Rs 40,000 from the employer).
In response to this, senior account officer, PGCI Shillong conveyed to Islamuddin that Rs 2,08,000 was sanctioned as his nonrefundable advance and a demand draft was made delivered.
The CBI registered an FIR case against the accused under sections 120-B, 409, 467 and 471 IPC after which he was tried by the CJM Imphal .
In its judgment pronounced today, CJM K Brajakumar Sharma said "In view of the findings made herein above, it is hereby ordered that the accused Angom Saratchandra is convicted under section 409 IPC".
