Th Shanti Kumar Singh, Supervisor Kanango Singh of the Settlement and Land Re-cords Directorate and L Brajmohon Singh, in-charge of Assistant Survey and Settlement Officer of Imphal West I have been issued show cause notices by the court.
The show cause notices were served as they refused to issue patta of a land at Langol Laimanai possessed by the petitioner for which the latter filed a reference original suit to refer the matter before the high court for initiating contempt proceedings against the duo.
Civil judge, senior division Manipur West had on June 17 asked the two officials either to appear before the same court or by a pleader on July 6 and show cause as to why the prayer of the petitioner shall not be allowed.
The petitioner who is also a member of the Laimanai Village Development Committee said the same court (Civil Judge, Sr Div) had on November 25 1999 passed a final decree maintaining that the petitioner along with some others are the owners of the suit land (Langol Laimanai area).
Meanwhile, a proposal for setting up an Ayurvedic College and hospital in Manipur has also been made and for which the State Govt has already issued an essentiality certificate, he said and added that the Manipur University too has given consent for its affiliation.
The final authority for giving the approval for establishing such college lies with the Central Council of Indian Medicine (CCIM) New Delhi and the Govt of India, he said adding that one of the criteria for issuing recognition certificate is that the proposed College should possess its own plot.
This being the case, the petitioner with the consent of the villagers agreed to donate his land for the establishing the college.
Subsequently the petitioner made an application before the in-charge assistant survey and settlement officer (ASSO) for issuing the Jamabandi of the land he possessed.
Later the ASSO referred the application to the supervisor Kanango (SK) Th Shantikumar Singh who examined and found it correct.
However SK refused to put the matter to the ASSO on the plea that the Jamabadi patta produced by the petitioner in the records is not available in the land records corrected upto 1960.The petitioner however clarified on the matter stating that the present tendered patta has been existing since only 1990 and as such it is not available in the land records corrected upto 1960.
