The Gauhati High Court decreeing that results of the election to the village authority in respect of headquarters Veng village Churachandpur district be kept in abeyance has also ruled that the State respondents state its position on the matter within ten days.
The court decree comes in the wake of the State Govt postponing the said poll to November 29, which was previously slated today.
Justice UB Saha in his Imphal bench sitting, yesterday passed the interim order following a writ petition filed by nine individuals (village authorities) headed by its chairman G Thangkhanthon.
Advocate Serto T Kom, appearing on behalf of the petitioners, impressed before the Court that election to the village authority of the said village was held on May 21, 2005 and the term supposed to last five years.
Subsequently, the Government (Secretariat's Hills Department) had on September 17 the same year approved election of the petitioners and published the verdict in the State gazette on September 28.However, on June 27, 2005 the Government issued an order annulling the poll results and re-constituting the village authority before the Court recently intervened and stayed the matter.
Contrary to the stay order, the Government issued fresh election notification for this village on November 16 saying that election would be held today (Nov 27).Challenging this order, the petitioners filed the writ.
The State represented by Principal Secretary (Hills), Deputy Commissioner and SDO of Churachandpur are the listed respondents in the case.
