The family members of Yumlembam Sanamacha who disappeared after being picked up by security personnel is all set to file a writ petition before the Gauhati High Court with a payer to direct the State police to re-investigate the case.
It is revealed from the prepared petition that Yairipok PS took up the investigation on the forced disappearance case but the same submitted its final report (FR) to the CJM Thoubal saying that the case had been closed as the personnel of 17 RR who were involved in the crime had left the State.
�The investigating authority did not conclude the investigation as the arrest of personnel of 17 RR involved in the crime is not feasible as they had already left the State of Manipur�, the prepared petition said.
The would be petitioners in the case include Yumlembam Ongbi Arubi Devi and Yumlembam Sanatomba Singh (32), mother and elder brother of Sanamacha of Angtha Mayai Leikai under Yairipok Police Station.
School boy Sanamacha, then 15, never returned home after being picked up by 17 RR men from his residence in the adjoining nights of February 12 and 13, 1998.Having observed an inquiry report that Sanamacha had neither been released nor handed over to the police after arrest, the Gauhati High Court had on Nov 29, 2001 directed the Central Govt to pay Rs 3 lakhs as compensation to the family of the boy.
The present prepared petition prayed before the Court to issue a directive to the State police authorities to re-investigate the FIR registered at Yairipok PS by a senior police officer so as to secure the arrest of 17 RR personnel involved in the crime and punish them according to law.
It also prayed to direct the Central Govt authorities- Secretary MHA and Secretary of Ministry of Defence and CO 17 RR to extend their co-operation with the investigating authority in all possible manner and also to make available all the 17 RR personnel involved in the crime.
