The Motor Accident Claims Tribunal, Manipur has asked the State Government to pay Rs 6,71,808 as compensation to the parents of one Gangmei Kabui, an IRB personnel, who died in an accident while going for election duty in a truck in August, 2002.The presiding officer of the Tribunal Ph Surendra Singh passed the order on September 8 following a Motor Accident Claim case filed by Gangmei Sanahal Kabui and Gangmei Chandani Kabuini, the parents of the deceased, Gangmei Kabui of Langthabal Khoupum, Imphal West.
On August 30, 2002, a large number of IRB personnel including the deceased were returning from Thoubal after election duty in two trucks, said the case dossiers.
When the trucks reached Hatta area, four personnel including Biren abruptly felt down on the ground owning to high speed driving.
Biren sustained serious head injuries while others received minor injuries, the dossiers said, adding that Biren was immediately rushed to JN Hospital where he succumbed to his injuries on the same day.
Porompat police have registered an FIR case on the matter suo-motto under section 279/338/304-A IPC.
The respondent of the case, DGP, Home Secretary, Ist MR and the driver of the truck, had earlier resisted the case on the contention that the truck was driven in a normal speed and death of Biren Kabui was not due to rash driving, the dossiers added.
In his verdict, the presiding officer said the compensation amount inclusive of the interim compensation of Rs 50,000 to the claimants within 30 days with interest at the rate of 6 percent per annum from the date of filing the case, i.e.October 31, 2003 till payment.
If the respondents fail to pay the amount within 4 months from the date of the said order, the rate of the interest shall stand increased from 6 to 12 percent, the verdict added.
