In a significant verdict, the State Government has been asked to pay Rs 6 lakhs as compensation to the family of one Arambam Dayananda Singh who was shot dead by a frisking party of 1st Manipur Rifles at Lilnakhong road near Manipur University on August 31, 1991.The order was issued by the Additional District Judge (Fast Track Court), Manipur East headed by M Ibohal on May 31 last following a Money Suit filed by the parents of the deceased youth, namely Arambam Ongbi Mani Devi and her husband Arambam Mangi of Langthabal Mantrikhong under Singjamei Police Station.
Case diary said that Dayananda, who had been recommended for job placement in the SSB, Mongsangei, along with his friend A Somorendro were going on a bicycle to visit his maternal grand-parents house for some private purpose, when they were halted by a frisking team of 1st MR led by Jamadar N Dhangge Meitei along Lilhakhong road.
While the frisking was going on, all of a sudden a bullet hit Dayananda and he died on the spot.
Dhangge who was the Defendant no 4 in the case, testified before the Court that Dayananda was killed during an encounter with underground members and the fatal bullet that hit Dayananda was fired from the underground side.
However, the Jamadar admitted that Dayananda was a civilian.
A Somorendro, the key Witness in the case stated that there was no encounter at the relevant time and that his friend was killed by a bullet fired by the frisking party.
The defendant also failed to prove that there was an encounter with the undergrounds on the said day.
After hearing both the parties, the First Track Court ruled that Dayananda was killed by' the MR frisking team.
The case was referred from the Court of Sub-Judge No 1 to the Fast Track Court on June 24 last year.
Besides Jamadar Dhangge, the other listed respondents in the case include the State Chief Secretary, DGP and CO of 1st MR.Man gets lifer for parricide: Additional Sessions Judge, Manipur East (Fast Track Court) M Ibohal Singh has sentenced a man who killed his own uncle to life imprisonment.
The gory crime had been committed way back in 1990 and the ruling was passed yesterday after establishing that the man was guilty of the crime under Section 302 IPC (murder).
While pronouncing the judgement, the Court also ordered the murderer identified as Chingangbam Imo alias Dinesh (37) s/o Ch Gulap of Kwakeithel Thounaujam Leikai to pay a su'm of Rs 20,000 as fine.
Case dossiers said that on the fateful day of December 11, 1990, Imo had a bitter quarrel with his maternal uncle, Konjengbam Sharat at the courtyard of his house at about 7 pm and in a fit of anger Imo who held a sharp knife stabbed Sharat on the stomach.
Sharat was rushed to the RIMS Hospital but succumbed to the fatal wound enroute.
Following a complaint, Lamphel police arrested IMO and registered a regular FIR case against him under section 302 IPC.
After the necessary police investigation, the matter was brought to the Court of Chief Judicial Magistrate (CJM), who referred the case for trail before the Session Judge, Manipur East.
Later the case was transferred to the First Track Court.
During the trial, the mother of the convict stated before the Court that though she did not see the action of stabbing her younger brother K Sharat, she saw her son Imo engaging in a quarrel with his uncle.
However, she testified that she saw Sharat being injured at the courtyard.
Forensic expert also opined that Sharat died of stabbing wounds.
Summing up case based on all available circumstantial evidences, the Court convicted Imo of parricide under section 302 IPC.
Pronouncing the judgement, the First Track Court said that 'it is proved beyond the shadow of any reasonable doubt that the accused Ch Imo, in his courtyard, intentionally stabbed his maternal uncle to death with a knife...'.
