Girl blackmailed, continuously raped for 5 years

In yet another crime against women, a 27 year old man identified as Konsam Loyumba s/o K Tomchou of Senjam Chirang Awang Leikai has been remanded to judicial custody by the Special Judge POCSO Imphal West, for blackmailing and sexually assaulting a woman over the course of five years.
The accused Konsam Loyumba was produced by the 10 of Women PS Imphal West with a prayer of Judicial custody remand till May 8 .
On the other hand the defense counsel of the accused filed a remand objection prayer and bail application for releasing the accused on bail.
The IO, through the APP submitted that on April 19, at around 6.30 pm, the victim of the case lodged a written complaint before the OC Women PS, as well as before the Court and the case was registered under section 4 of POCSO Act.
According to the complaint, the victim girl stated that on February 16, 2013, she was called by her boyfriend (the accused) to his house where he offered her tea and some snacks.
After having the tea and snacks, she started feeling drowsy and fell unconscious.
When she regained consciousness, she found herself fully naked from the waist do wn on the bed of the accused individual.
The accused allegedly took some pictures of her with his mobile phone and threatened her that he would upload the photos on social media.
The accused married another woman but continued to blackmail the victim and due to fear, the victim used to meet the accused who continued to sexually assault her.
The complainant became pregnant but underwent an abortion.
The 10, through the APP, further submitted that during the examination of the victim, she stated that the accused sexually assaulted her again and again by threatening/ blackmailing her and also cheated her by saying that he would marry her.
The accused was arrested by police on April 20 and remanded to police custody.
During interrogation, the accused allegedly admitted that he has been having a love affair with the victim since 2013 and took some photographs of the victim with his mobile phone and he established sexual relationship with the victim by threatening to upload the photographs on social media.
The accused also allegedly revealed that recently in the month of December last year, he impregnated the victim and as such he asked the victim to keep the baby as he is planning to take her as his wife soon.
The accused also allegedly revealed that his father in law is planning to give him a job in the month of the March and he told the victim to abort the baby as he would lose the job if he marries her and to do so, he allegedly gave five tablets to the victim to abort the baby.
He also revealed that he had deleted all the photographs he had taken using his phone.
The 10 further submitted that in a fit of anger, the victim consumed all five tablets at once and after her health condition worsened she took the help of her aunty who introduced her to one Thoithoibi.
The victim left home on February 26, and stayed at the residence of Thoithoibi.
On March 15, as the condition of the victim girl worsened, an abortion was arranged and the victim girl, along with her mother, Thoithoibi and one Priya, went to a clinic and the abortion was performed the same day.
On the other hand, the defense counsel submitted that the allegations levelled against the accused are baseless, as the alleged first incident of rape occurred in the year 2013 and the victim did not disclose the said incident till today and as such prayed for releasing the accused on bail.
After hearing both parties, the Court came to the conclusion that there is sufficient prima facie evidence against the accused for committing rape, cheating and criminal intimidation which are punishable under section 4 of POCSO Act, 376/417/306 IPC.
Hence the Court remanded the accused to judicial custody till May 8, and dismissed the bail application filed by the counsel of the accused.
