Despite the minor domestic help of former Chandel SP, T Samte, dropping the rape charge against the police officer, the Chief Judicial Magistrate, Chandel, S Sahadev Singh has remanded T Samte to judicial custody till May 17.The Court issued the order on May 3 at JN Hospital where the senior police officer is currently undergoing treatment.
According to case dossiers, Samte was arrested by the State police on May 2 at about 4.45 pm following the complaint filed by the minor domestic help that she was raped by the police officer at his Chandel official quarters on January 14 and February 3, this year.
Bail application filed by the former SP was also rejected by the CJM.
The Investigating Officer of the case prayed before the CJM to remand T Samte to judicial custody for 15 days to enable him to conduct the probe smoothly.
The IO further submitted that the prosecution case may be tampered and the prosecution witnesses may also be influenced if the accused is released on bail.
On May 3, the CJM along with the IO visited the senior police officer at JN Hospital (bed number A-2/private ward) to see his physical condition, the Court said.
Thereafter the ground of the arrest was read out to the accused.
The CJM also heard Samte.
The counsel on behalf of the accused maintained that his client is innocent of the charges levelled against him by the domestic help.
The counsel said that the charges were filed to defame and tarnish the image of the police officer.
The affidavit submitted by the supposed victim and her father to the DGP which said that they have dropped the charges against the SP was also mentioned by the counsel of the police officer.
After perusing the case material and having heard both the sides, the CJM ruled, "I have considered the nature of the allegations, gravity of the offence etc.
Considering all the circumstances in my considered view, there is no ground for releasing the accused person on bail in such initial stage of the investigation of the case".
After rejecting the bail application, the CJM issued the order remanding T Samte to judicial custody till May 17.In view of the physical condition of the senior police officer, the Court directed the SP Sajiwa Jail to give proper medical treatment to T Samte.
