In a significant verdict, the Court of Assistant to Deputy Commissioner, Shillong has ruled that the State of Manipur is entitled to repossess its land at Manipuri Rajbari, popularly known as Red Lands at Shillong.
The said land had been encroached upon by one Nismat Roy Laloo.
The order was passed by EK Sangma on August 3 last following a title suit filed by the State Government against Nismat of Shillong, sources said.
The Court ruling maintained that the plaintiff (State of Manipur) is entitled to a decree for ejectment of the defendant ( Nismat ) with destruction of all his structures from the suit land.
Among others, the defendant shall hand over the vacant possession of the suit land to the plaintiff within 90 days from the date of judgement, failing which the plaintiff shall be entitled to eject the defendants, his workers, agents or employees from the suit land by execution proceedings.
Located at East Khasi Hills district, the Manipur Rajbari, having an area of 81,888 sq feet has been a property of the State since the British period.
The land was, however, sold at Rs 2 lakhs by late Maharaja Okendrajit to two businessmen - Jemnud Pyngprop and Nismat Roy Laloo - in 1980.But following a public hue and cry, the State Got bought back the land from the duo at Rs 11,0000 in 1990.A deed of agreement was also signed between the two parties.
The present case followed after Nismat encroached upon some portion of the land measuring 33 to 10 ft (breadth) and 135 ft (length) and constructed a building in the area.
