Even as the final arguments of the Th Manorama Devi case is likely to be listed at the Principal Seat of the gauhati High Court this week a miscellaneous application has been filed by the family members of the deceased woman.
The Misc case was filed yesterday by Manorama�s mother Thangjam Khumanlei Devi and younger brother Th Dolendro Singh, said reliable source.
The two prayed before the Court to entertain them as respondents in the main petition and contest the same for ends of justice.
They also desired making public the Upendra Singh probe finding which was submitted to the State Government and direct the State take necessary steps including criminal prosecution of persons responsible for Manorama�s death, added the source.
The matter along with the main petition and two other Misc cases would come up for hearing tomorrow at the Principal Seat to be headed by Justice PG Agarwal.
The main case, it may be recalled, was filed by the Assam Rifles authorities challenging legality of setting up the Manorama death inquiry commission by the State Government.
Upon an interim verdict of the same court restricting publication of the probe report without leave of the Court, the State cannot table the matter.
It is also pertinent to mention that the Commission submitted its report to the Government on February 22, 2004.Court orders CBI probe into Tayeb Ali disappearance case: In a significant ruling, the Gauhati high Court has ordered inquiry into the disappearance case of Md Tayeb Ali by the CBI to establish identity of culprit/s responsible for the crime.
Chief Justice BK Roy and Justice T Vaiphei in their division bench sitting yesterday passed the order following a Misc application filed by the Army authorities.
Tayeb Ali, a salesman in a garment firm, was picked up in a white coloured Maruti van without registration plate from Poumai Colony at Sangakpham on July 25, 1999 with allegation of the same vehicle heading into then Assam Rifles stationed Kangla Fort through its northern gate.
Mention may be made that Families of the Involuntarily Disappeared�s Association, Manipur (Fidam) had charged the AR of involvement in the forced disappearance.
Based on Tayeb�s wife complaining to the National Human Rights Commission the latter had on May 31, 2002 asked AR authorities to pay Rs 3 lakhs as compensation to the victim�s family and the AR subsequently complying in February 18 one year later.
