Ruling that the DPC held for promotion of Y Joykumar to the post of DGP was not valid, the Central Administrative Tribunal has ordered fresh conduct of DPC within 30 days to appoint DGP anew.
The CAT directive was issued after hearing a complaint filed by senior IPS officer Peter Ngahanyui.
In his complaint, Peter challenged the induction of senior IPS officer Y Joykumar as DGP on July 23 by giving super time scale after conducting a DPC on July 19 of the same year.
It is informed that Y Joykumar is a 1976 batch IPS and Peter one year senior than the former.
After hearing the complaint, CAT Guwahati Judiciary Member NK Gupta and Administrative Member MK Chaturvedi issued a rule annulling the DPC conducted for promotion of Y Joykumar to the post DGP.
They further issued a directive asking the State Government to conduct a fresh DPC and appont a DGP anew.
During the intervening period before a new DGP is appointed, Y Joykumar may occupy his office DGP in-charge.
Advocate Moirangthem Gunadhor appeared on behalf of Peter Ngahanhui while Advocate Satyasen appeared on behalf of the Government.
The CAT also directed the State Government to finish the pending departmental enquiry over IPS Peter Ngahanhui within 60 days counting from February 12 .
