HC directs city police to reply on complaint

An interim report of the enquiry into the July 23 shooting incident that killed two people and injured five others conducted by a member of the Manipur Human Rights Commission has been submitted to the officiating chairperson of the Commission today.
Meanwhile, the Gauhati High Court, Imphal Bench today directed the City Police Station to give an official information on August 25 with regard to whether the police registered a case on the July 23 shooting incident in response to the complaint lodged by the mother of the deceased Ch Sanjit on August 7 last.
Member of the Manipur State Human Rights Commission, RK Rajendra conducted the enquiry into the July 23 shooting incident at Khwairamband Bazar after receiving a complaint note lodged by the husband of the victim Late Rabina Devi to the Commission.
The report was submitted today.
Husband of deceased Thokchom Rabina, Chinglensana lodged the complaint on August 17 .
Even though the report was submitted to the office of the chairperson as the officiating chairperson, S Gourachanbi was absent from the office today, no further action initiated.
In the three page enquiry report, it was stated that even though commission issued notice to the DGP to submit police report on the incident on or before August 17, the same is yet to receive from the DGP office.
"It is dishonor of the notice of the commission.
It amount to intentional attempt to delay the progress and credibility of the inquiry by the commission," RK Rajendra stated in the report observing that it may be taken as an attempt to conceal the criminal acts committed by any party and is violation of protection of human rights act 1993 .
He also requested the commission to send a reminder to the DGP forwarding the same copy to the state chief secretary for positive action.
In his forwarding to the report, RK Rajendra while observing that the non-co-operation intentional delay which may cause loss of evidence and timely action of the case, the commission may taken up legal action under the provision of section 13 of the protection of human rights Act 1993 and any other relevant rules of law.
However, it added, for the time being considering the urgency of the present burning issue, finding the facts for recommendation by the commission at the earliest for the welfare of the people and protection of human rights is outmost importance, the member observed and reiterated the commission to issue notice to DGP once again.
On the other hand, Gauhati High Court, Imphal Bench today has directed Imphal City Police to give a reply on whether the station registers FIR case with regard to the complaint lodged by the mother of deceased Ch Sanjit on August 7 last.
The case in the court was filed by the mother of Sanjit, Taratombi against the state chief secretary, DGP, SP, Imphal west and City Police.
The hearing of the court was conducted in the division bench of justice Maibam Binoykumar and justice Mutum Binoykumar.
During the hearing advocate Khaidem Mani, the counsel of the Taratombi observed that Sanjit was killed in an alleged fake encounter on July 23 by the police commandos and following the exposure of the fake encounter by Tehelka News Magazine with photos revealing that he was killed in fake encounter his mother lodged a complaint with the City Police with a plea to registered an FIR case on August 7 last.
But police informed that a case has already registered with the station.
He further prayed the court to direct the officer in-charge of the station to register an FIR case in response to the complaint of the mother and also direct the state government to hand over the case to an independent body like CBI to investigate and award befitting punishment to the police commandos involved in the killing of Sanjit.
