In a far reaching decision, the Supreme Court has set aside an earlier ruling of a High Court and directed that an MBBS candidate be given admission, by creating an extra seat if necessary.
The judgement was all that more significant as it came on October 5 this year, well after the deadline of September 30 set by the Medical Council of India to finalise all admission process.
A report carried on the December 22 issue of The Telegraph, said that the candidate Dolly Chhanda was selected for undergoing MBBS course in the Joint Entrance Examination, 2003 conducted in Uttar Pradesh under the reserved category for children/widows of armed forces/those disabled during action.
Chhanda's application was however rejected on the ground that the certificate issued to her by the Zilla Sainik Board contained a mistake.
Though the candidate produced a rectified certificate her admission was denied as admission had already been granted to candidates who scored lower than her in the JEE.
The High Court had earlier rejected her claim on October 31 last year.
However the Supreme Court set aside the earlier ruling of the High Court and ruled Chhanda belong to the reserved category and she should be given admission to a medical college, even going to the extent of directing that an extra seat be created for her.
