Although the CBI has submitted its report to the Court today, the State Government has yet again failed to furnish its status report on the investigation into the killing of Kasom Khullen SDO Dr Th Kishan and his two sub-ordinate staff by armed cadres of NSCN (IM) even after a lapse of three weeks.
Resuming the hearing of PIL no.6 of 2009, a division bench of Gauhati High Court comprising of Justice T Nandakumar Singh and Justice Mutum BK Singh took serious note of the failure of the State respondents to file the counter affidavit disclosing the stage of investigation even after a lapse of three weeks.
"We are not happy with the lapses on the part of the State respondents in filing the affidavit-in-opposition of the writ petition which involves public interest litigation with great magnitude," the Court ruling said.
However, after the Senior Government advocate Th Ibohal Singh who is appearing on behalf of the State respondents filed a comprehensive affidavit-in-opposition mentioning the stage of the investigation of the FIR concerned, the Court has granted three days' time for filing the affidavit.
It may be recalled here that the State Government has instituted a two-men committee to investigate into the killing and the committee had already forwarded its report to the Government.
On the other hand, the CBI to whom the case has been handed over by the State Government submitted its status report on the progress of the investigation to the court today.
