In accordance with the State Government's decision for a Judicial Inquiry into the Khwairamband Market incident of July 23 by a sitting Judge of the High Court, Law Secretary A Sukumar has left for Guwahati today to take up the matter with the Chief Justice of Gauhati High Court, informed a reliable source.
Though the State Government prefers the Judicial Inquiry to be conducted by a sitting Judge of the Gauhati High Court, it needs the approval of the Chief Justice of the High Court.
The Government believes that the enquiry would be of very low-profile in case the enquiry is conducted by a retired Judge of High Court.
In case, the Chief Justice does not allow any sitting Judge of the Gauhati High Court to conduct the enquiry, the State Government would need to take another decision on who would conduct the enquiry.
Even if the Chief Justice permits a sitting Judge to conduct the enquiry, the Government has no right to select a sitting Judge of its own choice.
However, the Government is confident that the Chief Justice would select a suitable Judge after analysing the events of July 23, conveyed the source.
On the other hand, the Government order issued earlier for Magisterial Enquiry into the same incident has not be revoked yet.
Once the formal order for Judicial Enquiry is issued, the official order for Magisterial Enquiry will be automatically annulled, the source said.
Though the exact date on which the order for Judicial Enquiry may be issued cannot be ascertained as yet, it is reported that it would take some time.
