Gujarat is nothing, check out Manipur

The "Gujarat fake encounter case" has the power to adjourn the Indian Parliament and become the front page of many of the number one newspaper and video media. Top officials of the police suspended in the said case in which it is said that the encountered person tried to assassinate the C.M of the state {Gujarat}.

Now let's come to the north-east India particularly in the State Manipur. If we check the list of the missing persons and the people killed in encounter then I think that Gujarat and the other states will be left behind as there is along list of the people missing here.

How many families have seen the drama at night to find their sons and daughters dead bodies without clothes in the morning with the marks of torture all over the body .

Even the male are not spared here in Manipur if they {the ones who picked them up) are not satisfied then they turn to other means such as humiliating the male body which is worse then the third degree torture.

The federalist say that "justice is the end of government" - "it has ever been and ever will be preserved until it is obtained". No wonder, therefore justice is always portrayed as the ideal purpose of government.

Now in Manipur being a federal unit of India do we live in a place where we get justice?

Well in Gujarat the person encountered is said to have come to assassinate the C.M of the State. I wonder what did Manorama tried to do as being a women as she was not spared by the Army.

When the commission took the case up, the persons accused just didn’t bother to turn up in the hearing. Later the home ministry claim that the the foresic report show no sign of rape.

Now how was the body thrown there then?
Who are the persons that picked her up that night?
Can a person be just killed and thrown in the fields just because they say that the person is involved in anti government activities?
Is the government with the common people or are they trying to hide something; they are not our government and they are suppressing us to make us theirs?

My question here is that is A.F.S.P.A. greater then the law? A place like Gujarat where there is no special power with the police if thing like that can happen there then how safe is Manipur?

Is the human rights really dead or they are in the politics with the government. Is the government of Manipur committed in finding the whereabouts of the missing people as it is a government we elected and its our people running the government.

If it is the government that we elected then they should really be interested in finding what is going on. The protection of human rights act section 2 1993 is still alive and is applicable in Manipur.

The functions of Human rights include
1. to inquire on its own initiative or a petition presented by the victim or any person on its behalf in to the complaint of

  • violation of human rights or abetment
  • negligence in the prevention of such violation by public servant.
  • intervene in any proceeding involving any allegation of violation of human rights pending before court with the approval of such court.
  • Preview the factors including acts of terrorism that inhabit the enjoyment of human rights and record appropriate remedial measure.

When we check the powers of human rights we find that according to the Code of Civil Procedure, 1908
  • Summoning and enforcing the attendance of witness and examining them as oath.
  • Discovery and production of any documents.
  • Receiving evidence or affidavits.
  • Requisitioning any public record or copy thereof from any court or office.
  • Issuing commission for the examination of witness or documents.
  • Any other matter which may be prescribed.

Well we see that we have all kind of protection in the papers of Law but while it acts why is it not so successful? When we have so many rights then why do we have so much persons missing in the State and so many encounters in the State .

Whenever a person is picked up and killed or he is not found, the police claim that the person was engaged in anti-government activities and the case is closed.

Now is that due to weak governance or the political influence - I think we deserve to know as the citizen of this country and the state. The human rights commission is headed by a D.G.P for investigation into complaints of human rights violation.

Under the act it is open to utilize the service of any Officer or Investigating Agency of the Central Government or the State Government. They may call for information from the Central Government or the State Government provided that they do not receive the report then they may proceed to inquire the complaint on its own.

Now as the investigating team is headed by the D.G.P can we say - does it act accordingly? Well I think that politics has a foul play in that. The government of Manipur at least see to the matter of missing people being picked up by the army, after all its our people and we think that it is a government elected by us.

Another problem is that in Manipur, the missing case only remains a concern of the state and its people. But in bigger states it comes out as a question of national interest why it is so?

Is it because they have more members in the Parliament and their members are a part of the so called "sarkar" {government } where in Manipur we have only there members of parliament which even if they want they can’t influence the Sarkar.

So after seeing all the things we have only one hope that the government of Manipur will do something for the missing people and the politicians in the Parliament from Manipur; If they cannot speak then well better be out of the name and fame they got.

We should also get the media to interfere in all the matters of human rights violation in Manipur. So that the world and the Goverment of other States should know that it is something very serious that is happening in Manipur.

Here in Manipur it is another place in the world; That we have something more than the darkness in the state during the night; That the uniform people which comes at night and pick the people and later find them either dead or missing.
