Imphal, Aug 01: The Gauhati High Court has dismissed a writ petition filed by some candidates who participated in the recruitment process held in 1999 for filling up 161 posts of graduate teachers that had been cancelled by the State before declaring the results.

The appellants' prayer was to declare the results of the DPC held during the month of December 1999 to January 2000.Case dossiers said a writ petition earlier filed by the appellants on the same prayer was also dismissed by the High Court on April 4 this year and challenging this order the appeal was filed.

Having heard all the parties, the writ appeal was dismissed by a division bench of the Gauhati High Court comprising of Chief Justice BS Reddy and Justice BP Katakey on June 30 this year.

'We are of the view that the judgement passed by the Single Judge does not suffer from any illegality requiring interference in the hands of this Court.

The appeal is, therefore, dismissed being devoid of any merit', the Court, in its principal Bench sitting at Guwahati, maintained.

The dossiers said the written test for recruiting 161 graduate teachers was conducted on November 8, 1999 wherein 14000 candidates appeared in it and the results were declared on the next day declaring 889 and 694 candidates as successful for Arts and Science Graduate teachers respectively.

A second select list was also published on December 24, 1999.Later viva voce was conducted by the Selection Committee.

But before declaration of the results of the viva voce by the Selection Committee, the Government had on November 6, 1999 issued an order banning direct recruitment and freezing the results of the selection committee.

During the proceeding of the appeal the State Advocate General Ashok Potsangbam argued that the State's policy decision taken by the Cabinet on March 7, 2001 on the basis of which the order dated March 19, 2001 was passed deciding to cancel all selection committee's proceedings when no results has been declared and also deciding not to make an appointment, having not been challenged by the appellants in this writ petition, they are not entitled to any relief as claimed in the writ petition.

It may be mentioned here that recruitment process of filling up total number of 679 post of graduate teachers from amongst the fresh candidates is underway.
