In the hearing of a writ petition filed with the Imphal Bench of Gauhati High Court, praying for taking up an FIR case over the killing of Rabina Devi in the July 23 Khwairamband Bazar incident, lawyer of the respondents today produced an FIR registered on the basis of the report of the police commandos.
A day after the incident, husband of Rabina, Thokchom Chinglensana filed a report with the City Police Station praying for registering an FIR case.
However, as the police failed to take up any action, mother of Chinglensana, Memi Devi moved the High Court on August 17 .
Consequently, on August 31, the Single Bench of Justice Ashok Potsangbam took up the writ petition for discussion and issued notice to the respondent for producing the detailed of the FIR case, if taken up any, by today.
However, in the hearing today, the lawyer of the respondent produced the detailed of the FIR registered based on the report of the police commandos.
The detailed of the FIR in question is FIR no.75 (07) 09 City Police U/S 302/326/307/506 IPC and 17/120 UA (P) A Act & 25 (1-B) Arms Act.
To this, the lawyer of the petitioner contended that the details of the FIR produced from the side of the respondent has nothing to do with the complaint.
After hearing both the sides, the Court fixed September 7 as the next hearing of the writ petition.
It may be noted here that acting on a ruling of the Imphal Division Bench of the High Court, the City Police had registered an FIR case in connection with the killing of Sanjit in the same Khwairamband Bazar incident.
Meanwhile, out of the five activists of the Apunba Lup arrested by personnel of Imphal West District Police yesterday, three were released today.
Of the arrested five activists, Mayanglambam Ongbi Radhesana Devi of Thangmeiband Lourung Purel Leikai, who is also the grandmother of Rabina; Oinam Amuthoi of Oinam Mamang Leikai and Yengkokpam Dhiren of Moirangkampu Mamang Leikai were released from the custody of Imphal Police Station today morning while the remaining two namely Oinam Bikramjit of Oinam Mamang Leikai and Mutum Ongbi Ibemhal Devi of Uripok Sorbol Thingel Leikai have been further remanded to police custody till September 4 with the permission of Chief Judicial Magistrate concerned.
Both of them have been charged under section 124-A/435/34 of IPC read along with 39 UA(P) A Act and 7 CLA.
The prosecution had sought permission for further remand of the duo in police custody for 6 days but the court granted remand only till 2 pm of September 4 .
With exception to Dhiren, the other four activists of the Apunba Lup, which is spearheading the ongoing public agitation over the July 23 incident, have been arrested together from the house of Ibemhal yesterday.
