Gauhati High Court, Imphal bench admitted an appeal of the state DGP to the court against the order directing Imphal city police station to register a case in connection with the shooting to dead of Th Rabina on July 23 at Khwairamband Bazar and investigate into it.
With the admission of the petition of the DGP which Imphal west senior SP and City police are appellants, the court also issued notice to all concerns returnable within five weeks time.
The DGP appeal is related with the order of the divisional bench of the court to register a separate FIR case on the killing of Th Rabina during the hearing on the writ petition filed to the same court by the mother-in-law of the Rabina, Memchoubi against the state chief secretary, DGP, Imphal west senior SP and city police.
The court however did not stay the order of the Justice Ashok Potshangbam on September 11 directing the city police OC to register a case on the complaint lodged by the husband of the Rabina, Chinglensana on July 28 with regard to dead of his wife.
The order will remain valid even though the appeal of the DGP prayed the court to stay the order of the single bench.
The DGP in his petition prayed the court to stay the order of September 11 till the case is disposed.
In the petition, it was also mentioned that the notice of the writ petition of Memchoubi issued by the single bench is yet to receive and respondents have many things to be submitted to the court on the matter.
Another appeal as state chief secretary as appellant against the September 11 has also been submitted to the same court.
In the order, it may be mention that the DGP and SP were asked to instruct the OC, City Police in translating the OC into work.
