The One-man Commission led by Justice (retired) PG Agarwal, enquiring into the July 23, 2009 shootout incident at crowded Khwairamband Bazar, could not be continue further allegedly owing to the failure on the part of the CBI to furnish the forensic test reports of the incident.
Chairman of the commission, Justice (Retired) PG Agarwal in its rulings had ordered CBI at New Delhi, investigating into the case, to furnish a report of the forensic test to the commission for examination as part of the enquiry to find out the fact of the circumstances leading to the firing of the police commando personnel that resulted to the death of two persons and injuring to five others.
At the latest, the commission directed the CBI to furnish the report in the last hearing.
However, the CBI authority is not furnished the report till date without giving any reason.
With no reply come up from the CBI, the hearing of the commission which was fixed on July 21 last was postponed indefinitely, an official source said today.
The hearing has been postponed as a result of non-received of the report, the source said adding that the date will be fixed only after the CBI furnished the report or give reply to the directive.
Whether the commission will continue or not is also likely to decide as per reply from the CBI, the agency investigating into the case.
Mention may be made that the Commission of Inquiry headed by Justice, PG Agarwal, a former Judge of the Gauhati High Court in enquiring into the July 23 shooting incident, in exercise of the powers conferred by-section 3 of the Commission of Inquiry Act, 1952 (60 of 1952). The One-Man Commission of Inquiry is enquiring into the circumstances leading the firing incident in which Chungkham Sanjit of Khurai Sajor Leikai, a member of the ban organisation PLA and Thokchom Ongbi Robina of Lamshang Bazar, Lamdeng Khunou, were killed and causing bullet injury to five others - Wangkheimayum Gitarani (40) wife of late Nongyai, Golmei Mangal Rongmei(59) son of G Lemba Rongmei of Mahakabui Nameihing Keithelmanbi, New Cachar road, Ningthoujam Kishorani (43) wife of N Ragumani of Narankonjin, Pangambam Lukhoi (30) son of late Pakchao of Heingang Makha Leikai and Kangabam Subhachandra (40) son of K Shamungou of Kha Potshangbam on July 23 at/around BT raod at Imphal.
