Acting on a petition filed against the order issued by the Director of RIMS on Feb 28 which enhanced the retirement age of specialists/teaching faculty of the institute from 60 to 62 years, the Gauhati High Court, Imphal bench has stayed the order until further orders.
Delivering the verdict, Justice BD Agarwal directed the petitioner to issue notice on the respondents within two days time.
The order was passed on March 19.Advocate BP Sahu who appeared on behalf of the petitioner said that respondent number 4, Dr Th Shantikumar Singh, Prof and HOD of Physiology was supposed to retire on Feb 28 this year.
However on the penultimate day, the Director of RIMS enhanced the retirement age from 60 yrs to 62 yrs of all the specialist/ teaching faculty with effect from Feb 28, 2007, said the Advocate who contended that the order is against the Constitution and by laws of RIMS.
The counsel also submitted that the Director of RIMS is not competent to enhance the superannuation age of its employees enbloc.
