The court of Judicial Magistrate First Class, Imphal has ordered release of two of MLA Okram Joy Singh's three sons who were arrested by police in connection with the April 13 violence at the office of Manipur People's Party (MPP).
The Court headed by Noutuneshori Devi, however, remanded O Joy's other son Okram Subhash to judicial custody for 15 days.
Subhash, his two brothers Debendra and Brojendro along with their mother Thoibi Devi were arrested by personnel of City Police on charges of obstructing official duty of the MPP on April 13.This followed a complaint filed by general secretary-designate of the regional political Oinam Jugindro Singh.
The police have registered an FIR case under Section 451 (criminal trespassing), 325 (assault), 307 (attempt to murder) /34 IPC.
Besides the case, the City Police have also registered two other FIR cases, one connected to an earlier complaint lodged by one Shyamsunder of the MPP in January this year against Debendra and other taken up as suo moto case by the City Police on the charges of assaulting its Officer-in-charge C Manihar Singh by O Joy's sons.
Yesterday, a Duty Magistrate had actually released the four on bail but as the three sons failed to furnish bail bond the trio were remanded to police custody.
On executing the bail bond, the mother was subsequently released by the Duty Magistrate yesterday itself.
Today, the three sons were produced before the Court with the Investigation Officer of the case (on Jugindro's complaint) praying before the court to remand them to judicial custody for 15 days.
Having heard both parties, the Court released Debendra and Brojen on bail on the duo's execution of PR bond of Rs 30,000 and a surety bond of the same amount while ordering 15 days remand for Subhash invoking 307 IPC (non-bailable).
interestingly, the City PS sought a formal arrest of Debendra in connection with the earlier FIR (january) but was not entertained by the Court.
Meanwhile, the MPP legislator clarified on certain issues relating to release of his two out of three sons as well as on detention of the third sibling picked up by police for their involvement in the brawl on April 13 at MPP office.
The released sons of Joy are Okram Devendra (38) and Okram Brojen (33).Injury marks were observed on the feet, backs and thighs of both of them as they were beaten up while in the custody of city police, pointed out the MLA.
It is reported that they were threatened not to venture again into the office of MPP and not to disclose to media that they were thrashed.
Both the brothers have been admitted to RIMS.
the duo's father O Joy while condemning the incident has remarked that the torture of his sons in the police custody was a criminal act perpetrated by state force.
Asserting that the police personnel involved in the incident are more cruel than wild animals, Joy disclosed that legal actions would be initiated against the police personnel involved in the matter.
He further maintained that the State Government must also take up befitting actions against the errant police personnel.
