Imphal, January 05 2010:
In its order of 23-12 2009, in regard to the PIL 1 of 2010, the Gauhati High Court, Imphal Branch directed "to entrust the investigation of the said FIR Case No 82(8) 2009 City P.S.in connection to the July 23 occurrence to the Central Bureau of Investigation" And that "The concerned I.O.of the said FIR Case No.82(8) 2009 City PS is to hand over all the relevant records including the case dairy of the said FIR case to the concerned officer of the Central Bureau of Investigation..." .
The PIL 1 of 2010 originally filed as writ petition W.P.(Cril) No.77 by Ch Taratombi Devi mother of Sanjit who was killed under controversial circumstances, on July 23 incident against the State of Manipur and 3 other was registered as a PIL on the direction of the Gauhati High Court "having regard to all the relevant considerations including the public interest involved..." .
A copy of the order was sent by the registrar of the Gauhati High Court to the Director of the Central Bureau of Investigation "for favour of doing the needful as per direction of the Hon'ble Court".
While passing the order, the Hon'ble Court observed "..since the accusations are directed against the local police personnel and since the Director General of Police has taken a stand about the occurrence, it would be desirable to entrust the investigation of the case, which has been registered on the direction of this court, to an independent agency like the Central Bureau of Investigation and that would lend the final outcome of the investigation credibility" .
While observing so, the court also noted "we mean no reflection on the credibility of either the local police or the State Government but we have been solely guided by the larger circumstances of justice " .
The state government, it is clear from the press note issued by the secretary to the Chief Minister, had no hand in the handing over of the investigation of the case relating to the July 23 occurrence to the CBI.
As per the press note a state cabinet meeting was held today which merely took note of the directives of the Gauhati High Court order of 23-12-2009 .
