Imphal, November 26 2009:
State police investigating into the case registered with City police regarding the incident of July 23 on BT road will examine the Editor of Tehelka weekly magazine, Tarun J Tejpal as part of the investigation into the case.
In the progress reports of the investigation into the case under FIR no.82(8)2009 City PS under section 302/34 IPC and 27 (3) Arms Act submitted to the court police also stated that they have also asked him to produce the original photographs and its negatives, soft copies and any other relevant documents or articles related to the publication which shows the pictures relating to the incident,.
Police submitted the progress report of the investigation to the Gauhati High Court, Imphal Bench comprising Judges, Justice K Meruno and Justice AC Uphayay as per directive of the court on October 29 last in response to the police intimation that as per the directive of the court on August 25, City Police registered the case.
Police filed the progress report on November 20 last which court has placed in the record.
In the report it was also mentioned that the investigating agency has taken necessary steps and will be shortly going to Delhi for investigating and examining the Editor of the Tehelka Weekly Magazine.
Police have decided examine the Editor at Delhi as he, through his counsel advocate Sourabh Ajay Gupta requested to examine in Delhi when police asked him to appear before the investigating officer for examination.
A team of police is to be left for Delhi in pursuance of the request and will be shortly going to Delhi for investigating and examining the editor and formalities required are under process.
The court also after examining the progress report directed the respondent of the case (authorities of state government) to furnish further necessary report after examining the persons concerned of the Tehelka Weekly Magazine with sealed cover after three weeks.
The court gone through the progress report filed by the respondent (police) which was found containing detailed of the investigation and considered the statement in the para 5 of the progress report as well as para 6 and 7 which opined "the said incident had arisen by publication of photographs contains in the Tehelka Weekly Magazine...." .
